On January 13, 2022, by Deed of Trust placed of record on January 18, 2022, at 10:45 a.m., in Official Record Book 126, Pages 230-246, in the office of the Register of Deeds for Houston County, Tennessee, (the "Deed of Trust"), Chase C. Defrancesco and Rachel Defrancesco, (the "Mortgagor") initially conveyed to Foreman Watson Lant Title and subsequently to Brittani B. Dial, being appointed Substitute Trustee (the "Trustee"), the hereinafter described real estate, to secure the payment of a promissory note as describedtherein (the "Note"), payable to the order of Altra Federal Credit Union (the "Holder"):
The Deed of Trust provided that in the event of default in the payment of the Note, when due, then the entire balance of the Note shall, at the option of the Holder, become due and payable immediately; and, default having been made and continued in the payment of the Note, the Holder of the Note, has declared the entire balance of the Note due and payable as provided in the Deed of Trust. The Holder, in accordance with the terms and conditions of the Deed of Trust, has instructed the Trustee Brittani B. Dial, to foreclose the lien of the Deed of Trust.
NOW, THEREFORE, by virtue of the authority vested in Brittani B. Dial, under the Deed of Trust, Brittani B. Dial will, on November 30, 2023, at 11:00 a.m. prevailing time, offer for sale and sell at the front doors of the Houston County Courthouse, 4725 E Main Street, Erin, Tennessee 37061, to the highest and best bidder for cash, and in bar of the rights of redemption, homestead and all other exemptions of every kind which the Mortgagor of the Deed of Trust or anyone claiming under or through the Mortgagor may have, all such rights and equities having been expressly waived in the Deed of Trust, the described real estate situated in Houston County, Tennessee as set out in the Deed of Trust.
Said sale will be held subject to (1) all accrued taxes; (2) terms, matters and conditions; (3) restrictive covenants; (4) rights of tenants in possession under unrecorded leases; (5) all matters on a recorded plan, restrictive covenants, easements, or setback lines that may be applicable; (6) any prior liens or encumbrances as well as any priority created by a fixture filing; and, (7) any matter that an accurate survey of the property would show.
Proper notification(s) were provided to the Mortgagor and other appropriate interested parties as required in Tenn. Code Ann. § 35-5-101 et seq. and other written agreements between the parties. No notification(s) were required to be provided to the Mortgagor or other appropriate parties pursuant to Tenn. Code Ann. § 45-20-101 et seq. (TennesseeHome Loan Protection Act). No notification(s) were required to be provided to the Mortgagor or other appropriate parties pursuant to Tenn. Code Ann. § 35-5-117 et seq. (Notice of Right to Foreclose).
The reference to the property identification is provided for convenience only. The above-referenced sale will be transferring the property as described in the Deed of Trust and any discrepancies between the Deed of Trust and the property identification will be governed by the Deed of Trust.
